A Monster Victory?

A small business from Missoula (USA) is caught in a legal battle with energy soft-drink giant Monster Energy Company. Monster Energy claims the company is infringing their trademark.

Victory Energize, received a letter from Monster’s attorneys, demanding the local company stop selling all products that bear the Victory Energize logo. Monster Energy is of the opinion it too much resembles their “Monster logo”.

Although many small companies collapse under such legal and financial pressure, Victory – probably relying on their name – decided to go to court.

Victory Energize sells caffeinated beverages at USD 0,99 per can. Monster Energy’s can is priced at USD 2,00 and has a similar color combination.

There is much to say about the similarities between the cans. But there are also a lot of differences to point out. This is not a clear cut David vs. Goliath-case.
