Heineken has lost a lawsuit against Romanian Csiki Beer Manufactury. Last year, the Dutch brewery sued the owner of Csikszentsimon brewery on charges of infringements of intellectual property, disloyal competition and unfair trade activities, for producing the Real Csiki Sor. Heineken stated the new product name is very similar to its own ‘Ciuc Premium’ beer.
It all started with Heineken objecting at the (European Union Intellectual Property Office (EUIPO), claiming that ‘Real Csik Beer’ is the counterfeit version of ‘Ciuc Premium’.
The lawyer of Csiki Beer Manufactory saw the positive decision coming: “We think it would have been difficult because the form and the quality of the product of Csik Beer Manufactory is better than the Heineken beer. Heineken believes that it owns the names Ciuc and Csik.
After the Supreme Court moved the lawsuit to Suceava, because Heineken believed the press coverage of the its lawsuit against Csiki Beer Manufactory and the “fame and sympathy surrounding it” would influence the objectivity and impartiality of the judges of the Marosvasarhely Court.
In the end the court dismissed the Dutch brewery’s appeal.
