In New York, a police officer arrested a clerk in Chinatown for selling counterfeit.
New York had already announced to intensify its policy towards counterfeit, but in this case it seems to have surpassed this goal. The counterfeit was found in a funeral store. According to Chinese tradition deceased people receive all kind of objects and products they can use in the new world. Because it is expensive to buy a TV or a car for a deceased person, people give their loved ones a symbolic cardboard of a bag, money, car or flat screen. During the ceremony, people burn these products.
Some of these products have are somewhat similar to Gucci or Louis Vuitton. But of course, it is no real counterfeit, but more a symbolic imitation.
In our view, a trademark owner will not have many difficulties with this sort of symbolic imitations. After all, in the event the trademark owner will achieve victory in the court and have seized all the concerning products for destruction, it goes up in smoke either way.
