Probably, as of next season, the intro of the Champions League migth be slightly different. That could be the conclusion from a recent application of the European UEFA. Remarkable fact is that the application concerns a design application.
The European design law generally protects the design of products (three dimensional products) and also logos and illustrations (2D). If the background idea of the current application of the UEFA is indeed to protect the intro (a short movie) this would be a new way of using design law.
UEFA took some frames of intro and filed these as illustrations. The interesting question is whether you can object against a movie on the base of an illustration (a still image). The criterion is whether the allegedly infringing design shares the same overall impression with the registered design. In MarkMatters.com’s opinion, it would be hard to attest an infringement, but still an interesting and creative approach!
