Champions League, a league for champions. At first sight, not a very distinctive trademark. But as we all know, distinctiveness is not a fixed value, it can be reduced (by dilution) and increase (by intensive use, popularity and reputation). The latter is certainly applicable to the Champions League, commonly known as the football league of the UEFA.
Still, as an opponent you have to proof the increased distinctiveness of your trademark, often a difficult hurdle. But the UEFA is successful in an opposition against the European trademark application PCL POKER Champions League. The OHIM calls the evidence not quite extensive but the documents that have been filed are convincing. And because the marks are similar, the opposition of the UEFA is successful. In this game, the UEFA is the champion!
