We came across a remarkable application in the European trademark register: the “Cocinelle” or “Deux Chevaux” of Citroën. This famous classic has been requested as a three-dimensional trademark for a wide range of products (from tableware to furniture and from jewelry to toys).
It is clear that Citroën wants to protect its classic car against abuse with this application. There will undoubtedly be a lively trade in objects that have the same shape as the Cocinelle. The question is whether such an objection will be successful. Opel has already tried it against Opel miniature cars which led to interesting case law of the ECJ. Ultimately, Opel was unsuccessful.
Citroën is not the first to file a car as a trademark. The Fiat 500 has already been registered as a brand, just like the Beetle from Volkswagen.
