Copy As You Are

The band Nirvana has sued for copyright infringement over Marc Jacobs’ Grunge Redux Collection, alleging that the fashion brand is infringing on the band’s copyright for its smiley face logo.

According to the lawsuit, the late Kurt Cobain created the iconic logo in 1991 and “Nirvana has used that copyright-protected design and logo continuously since 1992 to identify its music.”

In November 2018, fashion label Marc Jacobs released the Redux Grunge Collection celebrating Jacobs’ work with Perry Ellis in 1993. Several of the items feature the smiley face logo.

But the case gets juicier: the complaint notes that Marc Jacobs has apparently launched an entire marketing campaign that incorporates Nirvana references. One ad even features Jacobs himself wearing one of the allegedly infringing t-shirts above the words “Come As You Are,” the title of the group’s 1992 hit.

This smells like copyright infringement to us.
