Fender has a good package of IP rights: these guitar names are registered in the European Union and also the logo and the trademark Fender. Moreover, several guitar tops are registered as well. apparently the guitar player can recognize guitars by their top.
In America Fender will need its IP portfolio as it started a lawsuit against Keldon Swade, a guitar maker from Tennessee. He makes authentic vintage guitars. Fender accuses Swade that he causes confusion as he uses the trademarks of Fender.
An interesting matter. Can you sell authentic vintage products? If so, are you allowed to use the brand on it? Probably not, but are you then allowed to inform the guitar playing public that you sell vintage Fender guitars? Time will tell who will play the guitar!
