Leave it to the pros! Filing a trademark application may seem simple (it’s just filling out a form, right?), but it’s more complicated than people think.
Not only does a trademark attorney carefully asses whether you are filing the right mark; he/she may remove descriptive texts in the mark, file the mark in black and white or color (depending on use), and specify the goods and services for which the mark is intended.
Specifying the goods and services should be done very carefully: the specification should be sufficiently broad to cover all goods and services (even potential future goods/services), but also specifically enough to prevent unnecessary objections. Recent case-law has even made it more important to specify your intended purposes as specifically as possible.
And sometimes, when someone tries to file a trademark by himself, odd things may happen when describing the goods and services.
Yes… we trademark attorneys still are necessary.
