Last week we had a post about the movie Pirates of the Caribbean of Disney, now a new post about a copyright / trademark infringement in regard of an other blockbuster of Disney: Finding Nemo. These are obviously busy times for the trademark department of Disney.
A fish and chip shop in Adelaide has been open for some months now and is called Frying Nemo. Moreover, they use the above logo. They were actually surprised to receive a letter from Disney with the request to change their name and logo.
In a reaction they are using the common reply for small companies accused of an infringement: there are others with the same name (so?) and we are very small (so?). Especially the last argument is widely heard, but small infringements do not exist.
