Kobayashi is now being sued my Miles Davis Proporties LLC, a company that includes two of Davis’ children and a nephew, and that is the owner of the Miles Davis trademarks.
The alleged trademark infringement is not only about the use of the name “Miles”, but also because Kabayashi uses a silhouette of Davis playing trumpet, a silhouette that is also registered as a trademark.
According to the trademark owner: “Defendants are intentionally free-riding off the goodwill associated with the Miles Davis marks by using them to promote a jazz club entitled Miles’ Cafe in a way that is likely to mislead the public”.
Kobayashi’s reply may not be airtight legally, but is original nevertheless. Kobayashi claims that Miles Davis appeared to him in a dream and told him to change his first name to Miles and open a cafe in his name.
Well, that seems like indisputable legal consent, right?
