And yet another (alleged) fast-food trademark infringement! It was only last month that we posted about the In-N-Out Burger case.

This time it is about Houston, Texas restaurant Jus’ Mac. The restaurant specializes in gourmet macaroni and cheese. Yes, gourmet macaroni and cheese.

Much to the anger of the guys at McDonald’s. Their spokeswoman Angelica Rosas stated: “McDonald’s considers its trademarks to be a very important asset.”, although McDonald’s “hopes to find a mutually acceptable resolution to this matter. One possibility for Jus’ Mac is to add the phrase “a mac n’ cheese eatery” at the end of the name, so that it will not cause any confusion.

Earlier in June a California macaroni and cheese restaurant Little Mac was attacked by “Big Mac”. This name was eventually changed in “Homeroom”.

Legally, both (gourmet) restaurants may have quite a strong case. However famous the McDonald’s trademark is, it remains the question whether they can monopolize all trademarks containing the element ‘mac’.

Practically though, McDonald’s has deep pockets, so many of these matters will be settled, to their advantage, out of court. Fast, just like their food.
