My Little Problem

My Little PonyIn our previous post we discussed the consequences of brand extensions of well-known brands. The protection of the trademarks for the new products is a crucial aspect in this respect. There might be earlier trademarks that are already registered for these new products.

We just came across an example this week: My Little Pony from Hasbro, a trademark that is registered for toys and dolls. And a very famous brand, even for those without daughters age 2 to 7.

Hasbro wanted to protect its trademark in the EU for a logical side product: bags and clothes. However, this application encountered an opposition from a Spanish company, owner of a Spanish trademark My Little Pony, registered for bags and clothes.

This company was able to proof evidence of the use of its mark (the use requirements applied) and as the products and trademarks were similar, the OHIM accepted the opposition and rejected the trademark of Hasbro. All this, despite of the reputation of My Little Pony!
