When you do a trademark availability search you get an overview of all prior trademarks that may form a bar for the use and registration for your trademark.
But part of the search is also an advice on the registrability of the proposed trademark. Is the mark generic? Is it distinctive? An does it have a negative connotation?
Sometimes a trademark has meaning in another language that is negative for the trademark (see our earlier posts here and here).
In Australia the national authorities permitted the registration of the trademark NUCKING FUTS for a brand of snack products. Although clearly suggestive, the mark is distinctive and not considered to be contrary to morality and public policy.
