Before launching a trademark, you should check the availability. But it cannot hurt to check the packaging of your products as well.
When conducting a trademark availability search, the trademark is not only checked for availability (duh), but also a linguistic analysis is done: does the proposed brand have any negative connotation or other meanings you are not aware of? Such a check can prevent a lot of harm (see our posts here and here).
Often forgotten, but not to be underestimated, is the packaging-availability check*). This also can prevent you from making a big mistake. For instance, if your packaging looks like Hitler. Don’t forget to have your trademark attorney check this for you!
