index1We already posted about the fight between Pinterest and Premium Interest Ltd. The latter filed the trademark Pinterest in the European Union at first and blocked an EU application of Pinterest.

Finally, Pinterest won some. Pinterest contested the European registration of Premium Interest on the basis of unregistered rights. Whereas the Opposition Division rejected this opposition (and dismissed further evidence that was filed after the term), the Board of Appeal now rules (decision no. R0102/2014-2) that the new and additional should be taken into account. According to the Board, this evidence is likely to corroborate and to confirm claims and information which already had been provided in due time before the Opposition Division. The Board annuls the decision and remits the case to the Opposition Division.

As oppositions based on unregistered rights thrives on evidence, this is an important victory for Pinterest. To be continued!
