Something smells

Every now and then there is a case where you are in doubt about the similarity. A case you can’t exactly put your finger on.

Take this case for example: Prada filed a complaint in the US against Preferred Fragrance, Inc., claiming trademark infringement.

Prada states that the “PARTY CANDY” fragrance by Preferred Fragrance, is confusingly similar to “PRADA CANDY”, its own perfume.

But hey, can’t a fragrance company just put a partying girl on a pink, girlish backdrop? Answer: No of course not!!

Assuming Prada has protected the look-and-feel of the packaging, as well as trademarked the name, this is going to be a solid case for them. Wanna bet?
