Spot on

spotify logoSpotify is probably the hottest music streaming service out there. It is therefore very lucrative to make Spotify software add-ons. But be careful with the name you choose. Spotimote learned it the hard way.

Spotimote for Spotify. Does that sound like an app created by Spotify to you? Spotify sure does. And then suddenly the Spotimote app was removed from online software application stores.

Spotify is happy: “Spotimote includes a derivative version of the GREEN CIRCLE design. Further, the SPOTIMOTE term is confusingly similar to the SPOTIFY mark. The listing likely confuses consumers that the SPOTIMOTE FOR SPOTIFY app is somehow related to Spotify.”

Nodria, the developer of Spotimote, was astonished. They claim that they gain very little from confusing users. The remote is a remote and not a music player itself.

Well, this may be so, but still… it is very unlikely that the name Spotimote and the logo weren’t designed with Spotify in mind. To associate it with the famous brand. It’s like making lenses for cameras and naming it Cano-lens of Niko-lens. You get the point.

It’s clearly about using the well-known status of a brand for your own gain. And that’s an IP faux-pas.
