The allegedly infringing candy bar is packaged and labeled in such a way that it mimics Hershey’s well-known Reese’s.
The stakes are high: US sales of the Reese’s exceede $7 billion in the last five years alone.
The importers actions continue, despite protests by Hershey. Meanwhile, consumers are getting confused, the famous candy maker claims.
This should be a clear cut case for Hershey: the total appearance of the Reese’s bar is being copied: the orange packaging, the use of a similar font in identical colours. It is clear that everything has been designed to copy the well known packaging. Clearly they are riding Hershey’s coat tails and trying to unlawfully profit from Reese’s reputation.
If Hershey loses this one… we’ll voluntarily eat 10 Reese’s bars. If they lose, we’ll eat 8. A win-win situation.
