Black Tower Press, a small New York publisher has lost a law suit against Apple over use of the word “ibooks”.

In 2011 Black Tower Press, a publisher of sci-fi and fantasy titles, filed a law suit against Apple, after the computer company annouced their new product “iBooks”, software that allows users to purchase online books.

Black Tower has used the name “ibooks” for an imprint that sold millions of sci-fi and horror books in the early 2000s, but never registered the trademark. Apple, on the other hand, did.

A US Court now ruled that the word “ibooks” was – surprise surprise – merely descriptive for books sold on the internet. Black Tower also had not made the name famous enough that it acquired distinctiveness. Furthermore, no consumers would be confused by the two companies’ products.

Seems quite clear. No doubt about it. This iBook is closed.
