The pigeon and the pheasant. This sounds like the name of a children book. But these animals were the subject of a logo fight between the trendy fashion brand Jack Wills and House of Fraser (see our earlier post here). Both have a hat and cane/umbrella and are used in relation to clothing.
According to the English judge, the average consumer could confuse these two logo’s. Especially in view of the imperfect recollection and, this is a nice one, “the human eye has a tendency to see what it expects to see”.
House of Fraser has tried to convince the judge of the opposite. According to the defendant the logo of Jack Wills would be perceived as “the landed gentry, aristocratic shooting parties and the “feel of the English gentleman”. Their logo is Trafalgar Square and The Cities in London. Perhaps indeed a difference for the English consumer , but this difference was not enough for the judge.
