Competittors, Medallion Foods and Ralcorp Holdings, sell their “Bowlz and Cupz” chips in Walmarts and Krogers convenience stores. Frito-Lay didn’t like that their chips were so alike, and went all in: $4.5 million in damages as well as a total recall of any products that come close to looking like Scoops.
A Texas jury ruled against the Texas-based Frito-Lay. They were of the opinion that the the “scoop-shape” wasn’t as unique as Frito-Lay considered it to be. How else are you going to scoop a salsa on your chip?
