Trademark scoop

Frito-Lay (you know, the chips-guys) makes Scoops Corn Chips. As they call it: “a unique combination of great taste and good fun rolled into one great snack”. But is it indeed so unique?

Competittors, Medallion Foods and Ralcorp Holdings, sell their “Bowlz and Cupz” chips in Walmarts and Krogers convenience stores. Frito-Lay didn’t like that their chips were so alike, and went all in: $4.5 million in damages as well as a total recall of any products that come close to looking like Scoops.

A Texas jury ruled against the Texas-based Frito-Lay. They were of the opinion that the the “scoop-shape” wasn’t as unique as Frito-Lay considered it to be. How else are you going to scoop a salsa on your chip?

Fritos is still “reviewing its options”, so this story may be continued.
