Throughout the years we have seen remarkable trademark applications. The trademark application of the Vienna public transport company is definitely one of them: the application concerns the metro (subway) map of Vienna.
A metro map is quite a piece of design: it must show a complete network of lines and stops in a very simple way. Many of these cards are modeled on London’s metro map, which was the first with a simple map.
Why does Vienna public transport company want to claim this map? Often the motive for these brands is a defensive one: protection against abuse, for example use of the map on merchandise by third parties.
The big problem with this kind of signs is that only a few people see this as a trademark. This application was also recently rejected by the EUIPO. The exact ground has not been announced, but probably EUIPO is of the opinion that this sign is not capable of being a trademark.
